Specifc Terms of Services for FullEnrich Search Beta
These Specific Terms of Services for FullEnrich Search (hereinafter the "Specific Terms") apply between FullEnrich Corp, having its registered office at 28 Geary St, STE 650, Suite #346, San Francisco, CA 94108, United States (hereinafter "FullEnrich") and the company that has subscribed and decided to use FullEnrich Search via FullEnrich's website (hereinafter the "Client").
The Specific Terms govern the provision of FullEnrich Search by FullEnrich to the Client, as well as the Client’s access to and use of FullEnrich Search. The Specific Terms are specific to FullEnrich Search and supplement the terms and conditions of use and sale of FullEnrich (the “General Terms”) (https://fullEnrich.com/tos). In the event of any conflict or inconsistency between the Specific Terms and the General Terms, the Specific Terms shall prevail. Terms beginning with a capital letter have the same meaning as set forth in the General Terms. The Specific Terms form an integral part of the Contract.
FullEnrich Search is a new feature of FullEnrich, available in beta via the Software, which allows Users to access a database in order to create contact lists (“FullEnrich Search”).
Purpose
The purpose of the Specific Terms is to define the conditions for the provision, access to, and use of FullEnrich Search. By accepting the Specific Terms, the Client authorizes FullEnrich to provide FullEnrich Search to it and agrees to process the data necessary for the operation of FullEnrich Search.
The Client declares and warrants that it has the legal capacity or authorization from the person authorized to bind the Client to enter into the Specific Terms and to activate and use FullEnrich Search.
FullEnrich Search description
FullEnrich Search allows Users to access a database of contacts from which they may create contact lists based on job titles, seniority, professional experience and background, location, educational background, and the characteristics of the companies for which the contacts work and/or have worked. FullEnrich Search is an optional feature, currently under development, and available in beta version.
When FullEnrich Search is activated by the Client, Users may access the contact database, consult it, perform filtered searches, and extract the contacts they select.
The Client acknowledges being informed and having ensured that FullEnrich Search corresponds to their expectations and needs.
Access to FullEnrich Search
To access FullEnrich Search, the Client must have a Workspace, an active Subscription, and valid Credits.
FullEnrich Search is accessible only if the Administrator has authorized its use for its Users by accepting the Specific Terms.
Provision of FullEnrich Search
The Client commits to comply with the Specific Terms, the General Terms and applicable regulations when using FullEnrich Search and the personal data resulting from FullEnrich Search. It is the Client's responsibility to ensure compliance with applicable regulations regarding personal data, particularly to inform concerned individuals and, if necessary, obtain their consent, to process their data. The Client commits not to make any unlawful or prohibited use of FullEnrich Search and personal data resulting from FullEnrich Search.
The use of FullEnrich Search and resulting data is solely the Client's responsibility. The Client acknowledges that it has deliberately chosen to use FullEnrich Search in its beta version, which is not yet final.
FullEnrich Search may be used on a standalone basis or in combination with other FullEnrich services, in particular Waterfall Enrichment and Reverse Email Look Up.
Availability and evolution
FullEnrich does not guarantee access to or the continued availability of FullEnrich Search. FullEnrich reserves the right to modify and further develop FullEnrich Search. As FullEnrich Search is a beta version, access to it may be suspended, restricted, or discontinued at any time and at FullEnrich’s sole discretion. Under no circumstances may the Client rely on the unavailability or modification of FullEnrich Search to terminate the Specific Terms or the General Terms, to engageFullEnrich’s liability, or to claim any form of compensation.
FullEnrich does not guarantee the relevance or accuracy of the results provided by FullEnrich Search, and the Client acknowledges that errors may occur without FullEnrich’s liability being incurred.
The Client may deactivate FullEnrich Search at any time. In the event of deactivation, the Client may no longer use FullEnrich Search and, in particular, may no longer access or extract contact data.
The Client acknowledges that FullEnrich may add, modify, or remove functionalities of FullEnrich Search without these changes engaging FullEnrich's liability. Previous versions are no longer available and should not be used by the Client.
Duration
The Specific Terms shall enter into force upon their acceptance at the time of the creation of a Workspace or upon activation of FullEnrich Search where a Workspace already exists.
The Specific Terms shall remain applicable for as long as the Client has a Workspace. They shall terminate if the Client or FullEnrich terminates the General Terms in accordance with their provisions, if the Client deactivates FullEnrich Search, if FullEnrich discontinues FullEnrich Search, or when FullEnrich Search is incorporated into the General Terms. FullEnrich may decide to terminate the Specific Terms at any time by deactivating FullEnrich Search.
Subscriptions
FullEnrich Search is optional and supplements the FullEnrich services to which the Client has subscribed. FullEnrich Search is accessible in accordance with the Subscription applicable to the Client pursuant to the General Terms and the applicable Quote between the Client and FullEnrich.
Merely consulting contact data does not consume any Credits. Credits are consumed each time the Client performs an extraction from FullEnrich Search, in accordance with the pricing applicable between the Parties.
Liability
FullEnrich’s liability shall apply under the conditions set out in the Specific Terms and General Terms, and shall be subject to the same limitations and exclusions.
Personal Data
In the context of FullEnrich Search, personal data are made accessible to the Client by FullEnrich. FullEnrich and the Client act as independent controllers.
The data concerned include the contacts’ identity data (last name, first name), their professional information such as skills, professional background history (current and past positions, location, dates, seniority), education history, as well as the entities for which they have worked and the characteristics of those entities. Contact details such as phone numbers and email addresses are not processed by FullEnrich Search.
The Client chooses to access such data from the moment it activates the use of FullEnrich Search.
It is the Client’s responsibility to comply with the applicable personal data protection regulations for the processing operations for which it acts as a controller. In particular, the Client must have an appropriate legal basis, inform the data subjects, and, where applicable, obtain their consent. The Client is solely responsible for its use and processing of the data.
Modification
FullEnrich has the right to unilaterally modify the Specific Terms and the FullEnrich Search. The Client acknowledges that any modification is binding after they have been published by FullEnrich by any means, including via publication on its website or webapp.
The Client acknowledges and agrees that the Specific Terms and FullEnrich Search are intended to evolve, as FullEnrich Search is a beta version. FullEnrich Search is intended to be incorporated into the General Terms.
